LLC in Another State

An LLC formed in one state, a business in another

Plenty of owners form in Wyoming, Delaware or Nevada and live somewhere else. This site answers the questions that follow: do I register at home, what does my state charge, and who will handle it. Mainstay Filing is our pick for the paperwork.

The short answers

Can I form an LLC in another state?

Yes. You can form it anywhere. If you then do business in your own state, that state generally expects the LLC to register there as a foreign LLC.

Do I need to register where I live?

Usually, if the LLC does business there. The exact test is in each state’s statute, which the state page cites. The registration is called a foreign qualification or certificate of authority.
